The High Court has dismissed proceedings brought by the Official Receiver to disqualify former Kids Company Chief Executive Camila Batmanghelidjh and seven former trustees of the charity from acting as directors or being involved in the management of a company. In a 225 page judgment the Court found that the public needed no protection from the ‘highly impressive and dedicated’ trustees and that she was ‘wholly satisfied’ that disqualification was not warranted. Join us for an expert legal perspective on the case.

This unprecedented trial, keenly anticipated by the charity sector, challenged a number of fundamental principles on which the sector operates. It touches on a number of governance matters including the board’s supervision and control of the CEO, when a CEO might be held responsible for trustee decision-making as a ‘de facto director’ and trustees’ responsibilities when their charity faces financial difficulties.

We’re delighted to have Philip Kirkpatrick and Lucy Rhodes of Bates Wells to talk us through the case and its implications. Philip and Lucy bring expert insight as they and their colleagues acted for the former Chair, Alan Yentob and the majority of the trustees from the outset of the case, with George Bompas QC and Catherine Doran representing their clients in court.
